法律社會學基本原理

本書作者以羅馬法、英國普通法、歐陸普通法等不同類型法律的歷史發展為縱線，以法律的結構與功能為橫線，集中闡述了“聯合體內在秩序”這個關鍵性概念，並就此提出“活法”的思想，“活法”即聯合體的內在秩序，這是與國家執行的法律相對的社會執行的法律。社會並非是一個相互隔絕的抽象的個人集合，而是具有相互聯繫的人類聯合體的總和。這些聯合的內在秩序就是歷史的起點。他認為無論在任何時候，法律發展的重心都不在立法、法律科學，也不在司法判斷，而是在社會本身。
